Tim has developed a career in general insurance defence litigation. His practice has an emphasis on the defence of municipalities, health authorities, professionals, businesses, manufacturers, trades and educational institutions. Clients turn to Tim for his experience with mental health-related matters, medical malpractice, professional liability, construction, property damage, coverage, and occupiers’ liability matters.
Tim is adept at quickly assessing the strengths and weaknesses of a file and mapping out a strong strategy for the course of the litigation, in order to achieved the best possible result for his clients. Tim believes preparation is key to the conduct of any case, anticipating the opposing party’s likely position and arguments, and preparing to confront this when it is advanced. He is a proponent of taking a strong but reasonable position and sticking to it.
Tim always enjoys the opportunity to advocate for his client, has appeared before Provincial Court, Supreme Court, and Court of Appeal in British Columbia and has made written submissions to the Supreme Court of Canada. He has also appeared before the Human Rights Tribunal and the Coroner’s Court. However, he also believes in the value of alternative dispute resolution and the benefit of parties sitting down outside of the courtroom and negotiating the best possible resolution to the matter.
What is your favourite location to travel in BC?
Penticton. A beautiful, central location in the Okanagan Valley. After a day of Examinations for Discovery you have ready access to some of the best wineries in the country or amazing outdoor sports.
What do your friends need to know before considering a career as an insurance defence lawyer?
Truth is often much stranger than fiction. It is very interesting reading the new files that come across our desk because of the wide variety of situations we encounter. Many of which leave you thinking to yourself that no one could imagine this happening.
What is your deepest obsession outside of work?
Farmers’ markets and cooking. There is no better weekend day than going to a farmers’ market, getting the freshest ingredients and then cooking an amazing dinner for family and friends.
